Trade Conditions EDUA Languages, s.r.o. – Language courses

1. The company
EDUA Languages, s.r.o. company IČ: 290 133 72 (hereinafter EDUA Languages, s.r.o.) provides services in the field of language learning, management training and preparation for university entrance exams. These conditions adjust contractual relationship between EDUA Languages, s.r.o. company and a student of language courses and they are obligatory for both sides. The aim of the company is to provide students, our clients, with the highest quality educational services. It all is provided in a voluntary form with an emphasis to a friendly atmosphere in small groups of students.

2. Application
Contractual relationship between EDUA Languages, s.r.o. company and a student is built on the student’s order. Application for the course is noncommittal, it means that a student can withdraw from the contract till the expiration of the period fixed for the proper payment for the course mentioned in article 3 of this contract. The case of avoidance of contract after proper payment of the course is adjusted by the article 4 (cancellation conditions).

3. Payment
1) If more than 19 days remain till the start of the course, the whole course fee is payable within 14 days from the day of enrolment. The course fee can be paid by bank transfer, in cash at EDUA Languages, s.r.o. Customer Centre (Praha, Brno, Hradec Králové) or by cash subscription to an account of any branch of Česká spořitelna, a.s.
2) In case of enrolment between the 19th and the 14th day before the start of the course,  the whole course fee is payable within 5 days before the start of the course at the latest. The course fee can be paid by bank transfer, in cash at EDUA Languages, s.r.o. Customer Centre (Praha, Brno, Hradec Králové) or by cash subscription to an account of any branch of Česká spořitelna, a.s.
3) In case of enrolment between the 14th and the 7th day before the start of the course, the whole course fee is payable within 3 days before the start of the course at the latest. The course fee can be paid by bank transfer, in cash at EDUA Languages, s.r.o. Customer Centre (Praha, Brno, Hradec Králové) or by cash subscription to an account of any branch of Česká spořitelna, a.s.
4) If 7 days or less remain till the start of the course, the whole course fee is payable on the day of enrolment. The course fee can be paid in cash at EDUA Languages, s.r.o. Customer Centre (Praha, Brno, Hradec Králové) or by cash subscription to an account of any branch of  Česká spořitelna, a.s. substantiated immediately with a receipt of payment (in person, by fax or e-mail).
The EDUA Languages, s.r.o. company’s bank account is 6804392/0800, variable symbol is stated in the instructions for payment that the students will receive based on the order. 
5) Payment by education vouchers
a) EDUA Languages, s.r.o. company accepts Sodexho vouchers (Smart PASS, Fokus PASS, Dárkový PASS or FlexiPASS), Cheque dejeuner (UNIŠEK, UNIŠEK+) and Accor Services vouchers (Compliments Academica, Compliments Multi).
b) The whole course fee can be paid by vouchers.
c) EDUA Languages, s.r.o. company does not return cash to the mentioned vouchers.
d) On voucher payment a student can use from all the offered discounts the fidelity discount only.
e) If the course paid by education vouchers is cancelled by EDUA Languages, s.r.o. company or a student, the course fee is not returnable. The course will be cancelled based on the cancellation conditions (article 4) and the remaining sum of money will be kept by EDUA Languages, s.r.o. company as a credit for next period. A student can use this credit for any EDUA Languages, s.r.o. company’s course.
6) Payment by benefit points
a) EDUA Languages, s.r.o. company accepts payments by benefit points offered by Benefity Management company, Benefity company and Edenred Benefity Café.
b) You can pay the whole course fee or just a part by your benefit points.
c) EDUA Languages, s.r.o. company does not return cash to the mentioned benefit points.
d) If the course paid by benefit points is cancelled by EDUA Languages, s.r.o. company or a student, the course fee is not returnable. The course will be cancelled based on the cancellation conditions (article 4) and the remaining sum of money will be kept by EDUA Languages, s.r.o. company as a credit for next period. A student can use this credit for any course by EDUA Languages, s.r.o. company.
7) Penalty on late payment
If the student gets into default in payment while meeting obligations from the order, EDUA Languages, s.r.o. company can ask him for penalty interest at the level of 0,1% out of the outstanding amount for every day of default.

4. Lapse conditions
Conditions for cancellation of a course and reimbursement of the course fees are as follows:
1. Student cancellation before the start of the course - lapse charge amounting to 25% of the course fee.
2. Quality guarantee - in case of dissatisfaction with the course within the first two course days, 75% of the course fee will be reimbursed providing your written declaration (minimally in an electronic form to info@caledonianschool.com) stating your dissatisfaction is received by the third course day.
3. Student cancellation of the course after the third day of the course - lapse charge amounting to the full course fee.
4. The company reserves the right to make small changes to the courses (e.g. changes in syllabus, changes in venue, changes in classroom, changes in teaching materials, shifting or cancellation of a lesson etc.) and at the same time it reserves the right to cancel the course, or its part.
a) If a course is changed or cancelled, a student will be immediately informed by EDUA Languages, s.r.o. Customer Centre (SMS, e-mail) or on web sites www.caledonianschool.cz
b) In case of EDUA Languages, s.r.o. cancellation of the course or its part, a student can claim for reimbursement of a proportion of the course fee paid.
c) In case of reimbursement of the part of the course fee or the full course fee, the sum will be paid based on the customer’s request either in cash at EDUA Languages, s.r.o. Customer Centre (Praha, Brno) or by bank transfer to his account within 14 days.

5. Missed classes
EDUA Languages, s.r.o. does not provide any financial or other compensation in case of the absence of the client.

6. Student card
Forreasons of safety and protection of property, each student is obligated to identify himself/herself by his or her student card by each entering the school building to a particular worker without being requested.
a) Each fee paying student will receive a student card at enrolment for the course. Student card is valid with the completed student’s name and surname only.
b) Any student will not be allowed to enter the building, where the course takes place, without identifying himself/herself by his/her student card. If the course takes place in the building U Půjčovny, the student will also be allowed to enter the building after showing his/her identity card (eventually his/her passport).

7. Certificate
Each student attending at least 70% of the course can claim for a certificate stating the completion of the course.
a) The certificate is given on the basis of a written (e-mail, letter) or verbal (by phone, in person) request made at EDUA Languages, s.r.o. Customer Centre. The certificate is provided within 14 days after the request and completion of the course. The certificate can be collected by the student personally or it can be posted.
b) The certificate is not provided automatically.

8. Avoidance of contract
a) EDUA Languages, s.r.o. company can withdraw from the contract for the reason of filling to capacity of the course. Priority will be given to students who paid earlier for the course. The payment day is the date of receipt of payment for the course on the company’s account. In case of remittance of the course fee on the same day, priority will be given to students who ordered the course earlier.
b) EDUA Languages, s.r.o. company reserves the right to withdraw from the contract concluded with a student and to cancel student’s attendance at the course without compensation in case he/she endangers property or health of other course participants or teachers of EDUA Languages, s.r.o. company by his/her behaviour or will seriously disturb the run of the course.

9. Changes in the conditions
All changes in these Terms of Trade will be made in written form and with the agreement of all parties involved.

10. Personal data protection
a) EDUA Languages, s.r.o. company, IČ: 290 133 72, declares that all personal data supplied by students will be collected and processed for the purposes of service provided within EDUA Languages, s.r.o. company that commits to treat them in accordance with law no. 101/2000 Sb. of Czech Republic. If the contractual relationship is not concluded or a student does not further agree with keeping his/her personal data, the said data will be devalued.
b) By enroling for the course a student declares that in accordance with law no. 101/2000 Sb. of Czech Republic, regarding personal data protection, he/she agrees with processing of all personal data stated in the application form provided to EDUA Languages, s.r.o. company for the purpose of conclusion of the contractual relationship and marketing purposes of EDUA Languages, s.r.o. company. A student gives this approval for the period of duration of such a contractual relationship and further for 2 more years since the end of such a contractual relationship.

These Terms of Trade are valid since 18.12. 2012.
